The heirs then hold a foreign certificate of succession, but in Croatia they must register the specific asset: real estate, a boat, a yacht or another asset subject to registration.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The problem is particularly pronounced when probate proceedings are conducted in Germany. A German certificate of inheritance and a German European Certificate of Succession generally confirm who the heir is and the share in which that person inherits, but they do not list every individual asset in the estate. Such a certificate may be sufficient to prove the status of heir, but it may not be sufficient to register a specific asset in a Croatian register.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Croatian registers do not register an estate in general terms. In the case of real estate, a specific land-register parcel is registered. In the case of a boat or yacht, a specific vessel is registered. A berth involves an additional consideration: in most cases, a berth is not owned but constitutes a right of use or a contractual relationship with a marina, port or port authority.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For this reason, resolving the matter afterwards may take time. In the meantime, costs may arise, the asset may be impossible to sell or use, problems may occur with the registration of the vessel, or there may be a risk of losing the berth..<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-black-color has-text-color has-link-color wp-elements-ebf135a66b8ecc244eaa317ba14a0d6c\" style=\"font-size:32px\"><strong>Regulating property-law relations during the owner\u2019s lifetime<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">If it is clear during the owner\u2019s lifetime who should receive a particular property, boat or yacht, it is legally safer to consider regulating the matter while the owner is still alive. This reduces dependence on a foreign succession document and on the Croatian registration authority\u2019s subsequent interpretation of that document.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The principal advantage of a lifetime transfer is that the legal transaction is drawn up for a precisely identified asset. The contract does not refer to the estate in general terms but identifies the specific subject matter of the transfer and its identification details. This reduces the risk of a delay after the owner\u2019s death due to the asset not being sufficiently specified in the foreign certificate of succession.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The most common instrument is a gift agreement. A gift is appropriate where the owner genuinely wishes to transfer ownership to another person immediately. If the owner wishes to retain control over the asset, a gift is not always an appropriate solution, or it should be combined with additional rights, such as a right of usufruct or a right of residence in the case of real estate.<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-black-color has-text-color has-link-color wp-elements-84809acd9936c10da731df8b6d4e2d75\" style=\"font-size:32px\"><strong>Real estate and possible forms of transfer of ownership<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In the case of real estate, the advantage of a gift is that the agreement states the exact land-register details and can serve as the basis for registering the new owner in the land register. Ownership is thereby transferred before the owner\u2019s death rather than through subsequent probate proceedings abroad.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Within family relationships, a gift subject to retention of a right of usufruct or a right of residence is often considered. Ownership passes to the donee, but the former owner retains the right to use the property. Such a solution may be appropriate, for example, where a parent wishes to transfer property to a child while continuing to live in it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before entering into the agreement, the state of the land register, tax consequences, matrimonial property, existing encumbrances, the position of other future heirs and the issue of the compulsory share should be examined. An inadequately prepared gift may give rise to a dispute among the heirs after the donor\u2019s death.<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-black-color has-text-color has-link-color wp-elements-7a4bc7a5eaf13a9d01e6cf404cc57acc\" style=\"font-size:32px\"><strong>Boats, yachts and the issue of berths<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In the case of a boat or yacht, a gift can resolve ownership of the vessel during the owner\u2019s lifetime. After the agreement is concluded, the change of ownership must be registered in the Register of Ships. This avoids the subsequent need to prove that the specific vessel formed part of the estate, particularly if the foreign certificate of succession does not identify the vessel.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The issue of the berth must be examined separately. Transfer of ownership of a boat or yacht does not automatically transfer the right to the berth. The contract with the marina, port or port authority may be tied to the current user personally, so before transferring the vessel it must be determined whether the new owner may continue to use the same berth and on what terms.<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-black-color has-text-color has-link-color wp-elements-51bbf71af6a4b55379847cfefb67e91d\" style=\"font-size:32px\"><strong>Limitations of gifts and the need for prior review<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A gift is not appropriate in every situation. It is not a suitable solution if the owner is uncertain to whom the asset should be transferred, wishes to retain complete control, or if there are serious family disputes, debts, creditors or a risk that the gift will later be challenged.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A gift must be distinguished from a will. A will governs a person\u2019s wishes in the event of death, but probate proceedings and registrations must still be completed after death. If the problem is precisely that the foreign succession document does not identify the specific asset, a will may not eliminate that risk completely.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In some cases, a sale and purchase agreement, an agreement on lifelong support or support until death, a gift subject to retention of certain rights, or another solution may be more appropriate. The choice depends on the type of asset, family relationships, taxation, the owner\u2019s interests and the time at which the transfer is intended to take effect.<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-black-color has-text-color has-link-color wp-elements-0478d14102c52657fa4a0ea11ba7f6fd\" style=\"font-size:32px\"><strong>Concluding considerations<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Where assets in Croatia are connected with an owner who lives abroad, the issue should be considered in advance. Difficulties may arise after the owner\u2019s death because a foreign certificate of succession may not contain the information required by a Croatian register for registration of the specific asset.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the owner\u2019s intention is clear, a lifetime transfer of the asset may be more effective than resolving the matter subsequently through probate proceedings. A gift agreement may be a useful solution for real estate, boats and yachts, but only if the tax, family-law, succession-law and registration consequences have been examined before signature.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the case of boats and yachts, ownership of the vessel and the right to the berth must be considered separately.
